Psystar sues Apple
I think that by this time we all know the Open Computer maker Psystar or heard about them somewhere. They made their existence known when they start to build and ship out intel based computers installed with Mac OS X not minding that they a re robably breaking the terms of Apples EULA. Psystar didn’t start out too well as they encounter several issues about the legality of their company or even of their existence. And looks like they did because Apple filed a lawsuit against them last July 3 on the ground of copyright infringement, filed in the U.S. District Court for the Northern District of California.
Apple’s action doesn’t seem to affect Psystar when they hired lawyers that previously faced Apple before. Psystar will be represented by lawyers from Carr & Ferrell LLP, a Palo Alto, Calif.-based firm that touts its intellectual property (IP) expertise on its Web site. Three Attorneys, including Colby Springer, Christine Watson and Robert Yorio, a partner at the firm.
It is business as usual for Psystar as they still continue to ship out Open Computers, used to be OpenMac, and they even sent out free Leopard Restore Disc to their costumers a few weeks ago.
But this time the tables have turned and Psystar is the one to sue Apple.
SAN FRANCISCO -(Dow Jones)- Attorneys for embattled computer maker Psystar Ltd. on Tuesday alleged the rules for buying Apple Inc.’s (AAPL) Macintosh operating system software involve “anticompetitive tactics.”
Psystar, based in Doral, Fla., is challenging Apple’s requirement that only Apple-branded devices use its software, which Pystar contends illegally ties the sale of one product to another. That’s not the case with operating systems software from Microsoft Corp. (MSFT) or the open source Linux, which can be installed on devices from any number of manufacturers, Psystar said.
Psystar made its claims at a press conference Tuesday, during which it said it will soon file a legal complaint against Apple alleging the Cupertino, Calif., computer maker is engaged in unfair competition and an attempt to monopolize and other violations of U.S. antitrust acts. [via CNN]
Looks like this battle is not going to end soon. We understand that Psystar is only trying to the Mac Os X to the masses but we also know that somehow it is violating some terms from Apple’s EULA. We will keep you guys updated of the latest news about this battle.
